LokPal,World_Press_Index,&Gangrape_charges

LokPal Bill: The bill's amended version is approved by the Cabinet today. The govt. had indicated that it would try to get it passed in Rajya Sabha. However, AAP party head, Arvind Kejriwal, had stated that it is not possible to arrest any corrupt through the said draft bill. The govt. is trying to save them. But Kiran Bedi differed from him stating that the govt. had tried on it.
The bill states that after it is passed by State govt., it should be implemented, duly appointing a LokPal, within a year. Besides, NGOs have also been brought under it. Many recommendations of the select committee had been included in it. Earlier during 2011, the govt. tried to get it passed but it was held in Rajya Sabha for some considerations. Also, UPA chairperson had wrote to veteran social activist, Anna Hazare, stating that it would be sooner passed in the LokSabha.
 
As per the World Press Freedom Index, India had got 140th position & ranked lowest in Asia regarding freedom of reporters. Turkmanistan, N.Korea & Iritria like nations have also ranked lowest. The topmost countries are Finland, Netherlands & Norway. China had got 173rd position. The Non governmental organisation, "Reporters without borders" had issued the said list for the year 2013 but it had not commented upon the prevailing political system. It had also made it clear that the countries providing correct information are those, where human rights are properly safeguarded.
As per the NGO's secretary, the dictator ruled countries reporters had been suffering for their work whereas in democratic countries, media has to compromise along with for economic reasons. India & many other countries had gone down in ranking where regional models are given preferences. After year 2012, South Asian reporters conditions had suffered badly. Maldives had gone down to 103rd rank. The media reporters are said to have been targeted after their President's resignation. Likewise, condition had worsened in Pakistan, Nepal & Bangladesh etc.
Delhi's Gangrape charges: The charges on accused regarding Delhi's Gangrape incident would be fixed on Saturday. Also, a petition had been filed for trial of juvenile's case along with the other accused. The said petition is filed before the Supreme Court. Earlier, Juvenile Justice Board had declared him to be not adult, which had agitated people's mind.
The arguments regarding charge sheet would be completed on Saturday with the charges being fixed for trial against the accused at the recently constituted Fast track Court. Earlier, a petition regarding transfer of case to outside any State was rejected by the Court. It had also warned media of taking undue coverage of the pending trial.
It is to note that past year Dec. 16, a paramedical student was gangraped in a luxury bus resulting in her death too. Juvenile board had rejected the bone density test & considered the date of birth certificate to be the basis of declaration of the said order, wherein he was declared juvenile. Delhi Police would file a case before High Court in this regard although requisite provisions are there where case could be run under JJ Act 15.
Justice Verma Committee was set up with it's recommendations already being handed over to the govt. in this regard. However, it's detailed report being uploaded in the Home ministry's website is unavailable due to link failure.
Delhi State govt. had already assured of education of her brother/sisters along with a compensation of around Fifteen lakhs INR granted in this regard.

Egypt,LokPal,Juvenile_Board,&6Lit_festival

Egyptian Protest: Egyptian President, Mohammad Mursee, had declared emergency in three cities for about a month in view of people killed during demonstration held against the govt. The political crisis had deepened.People have come out in open at Port Saed, Svez, & Ismailia. During past week, forty nine (49) people got killed. The violence continues on fifth day also. People have been occupying the Tahirir Square with police firing tear gas bombs. They claim that the govt. had cheated the protesters. They want "Islamic Brotherhood" to be ousted from power.
It is to note that youths in China had also come out in open at Tian-an-man Square but the protest was curbed violently by the Chinese military junta.
Anti-Corruption rally: Prior to the commencement of the Jantantra rally, UPA chief had stated in a letter to Anna Hazare, the Gandhian & veteran social activist, that the LokPal bill shall be passed during the next session of the Parliament. The said rally would be organised on Wednesday. The LokPal bill had already been passed in the LokSabha. It is already declared ineffectual by the Anna & his supporters with Team Anna being dissolved. The venue of the rally would be Gandhi maidan, Patna. Anna had told that he would raise the issue prior to the General Elections.
India had developed K-15 missile capable of being launched, along with nuclear warhead, from a submarine undersea to hit the target. It was tested for eleventh(11) time at Vishakhapatman from a Bengal Pantoon Platform.
Delhi's Gangrape: Amidst public outcry demanding death penalty for all six accused, the last one who had been claimed as not being adult, was subjected to bone density testing. It had also been found in his school certificate, as was told orally by his family members, that his date of birth is June 4, 1995. Delhi Police would go against the Juvenile Justice Board's decision of considering the school certificate as the basis for determination of age. Now, the case would be subject to JJ Act Section 15. His trial would run as per it. Provision for appealing against the said order may not be considered by the Delhi Police. Many organisations have been demanding to consider him at par with other accused.
It is to note that on Dec. 16, a paramedical girl student was gangraped by six accused in a luxury bus & thrown outside bare along with his boy friend. Except the one, all others trial is going on in a Fast track Court.
The sixth Jaipur Literature Festival's had been in controversy over Dalit issues. After Prof. K.Illaiah, who spoke on "God as a political philosopher; Buddha's challenge to Brahminism" evoked it, Professor Ashish Nandi of CSDS claimed that SC/ST/OBC had been the most corrupt in the society. As per Prof. K.Illaiah, he had not been along with bad motive behind his bad statement. As per him, Buddhism is better as compared to Hinduism as conversion grants equal rights like Hindus. It is to note that he is Head of Maulana Azad Urdu University, Hyderabad. He had authored two books viz. Why I'm not a Hindu & God as a political philosopher. His statement were opposed by Literateur & Cine writer, Javed Akhtar, and Ajay Nevaria along with Nirupma Dutta. The next Professor Nandi is brother of Pritish Nandy, who had been a media person. His statement had made people lodge an FIR against organisers at Ashok Nagar's Police Station by Rajasthan's social classes. It is also a case of media engulfing the literature world.

Chicago_Court&blast_acquittal

India would start afresh it's demand for extradition of Mumbai blast acquitted & Lashkar terrorist, David Headley. He had been sentenced to 35 years of imprisonment by a Chicago District Court.
As per the Judge, he had committed a crime, co-operated for it & was awarded for it too. His decision would not stop terrorists as they don't accede to it. He is suspicious of David Headley's statement that he had changed. The public needs to be saved from Headley. But as the US govt. had recommended only 30-35 years of imprisonment, he had accepted it. He is worth hanging. He had cooperated during trial.
As per US laws, a person, after being sentenced, can't be extradited. The US Court had held Headley responsible for killing of six US citizens. Rana too had helped Headley but is not convicted for Mumbai blast.
India is in process of extraditing Headley for his involvement in other terrorist activities. He had done recce of Pushkar & Delhi's regions & handed over to Lashkar terrorist outfit. These are left-out charges against him. India would seek further interrogation of his girlfriend & wife too. It might also be thatwithout their acceptance, interrogation may be denied by the USA.
USA had denied Headley's extradition citing his being govt. witness & providing relevant information about other terrorist outfits to the investigating agencies.
It is also learnt that Headley had agreed to present himself in any outside judicial process through the video-conferencing medium. Headley's counsel informed in Chicago Court while denying his extradition.

2014Campaigning

Whereas Rahul Gandhi had been made no. 2 in the Congress with emotional sceneries, the youth Congress had been seemingly inspired. With Rahul Gandhi's continuing tradition of gaining power with sympathy votes, he had shaken the hearts of many Congress party men. Earlier too, he had been handed over the charges of coordinating the election campaign for 2014 general elections.
Since then, many had worried over how would BJP continue it's campaign for the elections. With many such Star Campaigners inside it, various groups had emerged aspiring for the PM's candidature with the most noticable, Gujarat CM, Narendra Modi. Even, the Congress Star Campaigners accumulated against him during the Gujarat assembly elections. But Modi had, amidst friends & foes, been a technology rider with his 3-D campaign & endless meetings despite his strong image due to Hindu-Muslim riots. He won the hat trick on his own citing "Vibrant Gujarat" development despite
the third party, GPP, coming to fore as the party of dissidents. Although GPP could not gain much so as to prevent him from winning the elections, it has a seemingly big list of such people.
Indian National Congress had also said the Anna Hazare supporters as the "left-out people" from the politics & more so often suppressed the movement against corruption for the reasons best known to them, their special character, Manishanker Aiyer, was also against Modi & campaigned against him. He has a special reference  to him despite his being calling Parliamentarians as monkeys/animals etc.
So, with the upcoming elections nearing, Modi would definitely be the star or prime campaigner for BJP. Many have troubled about his involvement in the riots with the recent one being the British High Commissioner, who had recently attended the Vibrant Gujarat summit. It could be a toss on being right or wrong. But it would be the public to decide whether to have Modi BJP with development or the market-oriented & the hidden faces.
The seemingly important thing is the Supreme Court's verdict on Gujarat's LokAyukt, who would soon be checking the authencity of the Vibrant Gujarat's claim or the growth graph shown by the Modi govt. His land bill had already been passed despite it's reluctance by the Governor of the Gujarat.
It is also noteworthy to mention that the Anti-Corruption movement has lost it's lustre amidst politics & political compulsions but the RTI had survived or remained at the forefront though many people have complaint about it too along with the complaints of getting harrassed through it. So, when the Western media propagates a thought on Modi versus Rahul Gandhi, one has to definitely take many such factors into consideration as to have the correct amount of modesty in it. The Western media claims that it has more to do with the book titled, "Decoding Rahul Gandhi" by "Aarti Ramachandran" rather than the western thoughts involved in it.
Secondly, after the Babri masjid demolition, L.K.Advani remained PM-in-waiting till today. Modi has to come to the fore for atleast having increased vote percentage for the party. After Atal Bihari Vajpayee, today would be the merger of Jankranti party(Nationalist) for assimilation of such party cadres. Modi had been able to get the work done by bureaucracy upon his own image & vision.
Apparently weak point for Modi is that other factions tend to get dismayed like JD(U). Many others include BJD, AIADMK, & TMC etc.

Gangrape_opinions&Juvenile_act

RJD: The Rashtriya Janata Dal (RJD) chief, Lalu Yadav, had demanded death penalty for Delhi gangrape accused citing his visit to Balia, where the victim's father narrated about her daughter's incident. It seems that he is in favour of disclosing victim's name, which is not to be told as per law. He had told that in this case, the victim has died & the name could be disclosed. He had told about the Arabic countries where rapist are stoned to death. He had told that he would pressurize the govt. to make such law of death penalty. He had cited that if abduction of Sita could lead to killing of Ravana, why rapist shouldn't be given death penalty?

Delhi Police: The Delhi's Police Commissioner told that after the Delhi's gangrape case, there is a revolutionary change taking place in Police force as well as Indian Criminal justice system. After 1980s Ranga-Billa case, Dholakuan case & present gangrape case, Police was forced to undergo change in regard to women's crime about their working and thought process. During the Annual Press conference of Delhi Police, he told that crime against women folks won't be tolerated further. He declared about increasing vigil in Delhi area. He also stated that now women helpline would work 24 hrs round the clock. If any women registers complaint, there would be no dispute regarding the area covered. Also, traffic police, Police picket, PCR & police personnel had been deployed. Fast track Court is also constituted for hearing such cases.
Besides, station level committee would be freshly constituted with inclusion of women self-help groups. The Police & PCR van would be deployed outside such schools & colleges.

Gandhiji: It is stated that Father of the nation i.e. Mahatma Gandhi was also affected with such instances of rape. The President of India had revealed this during unveiling of statues of freedom fighters at East Midnapore district. He told that in Tamluk, a parallel govt. known as "National govt." was constituted, which had Ajay mukherjee, Satish chandra Samanta, Sushil Dhara etc as having key roles. Later Gandhiji got a complaint that they are turning violent as they could do anything but not rape. Sushila Nair, who came along with Gandhiji, asked about it from women folks who confirmed it.
Gandhiji went & came with his tears filled eyes stating that he doesn't consider them guilty but it would have been better had there been no such incidents.
PIL:The Supreme Court had issued notice to the Central govt. on Delhi's gangrape upon hearing two PIL petitions filed before it seeking trial of juvenile with priority of seriousness of matter & maturity rather than his age. Also, his mental state should be tested and if found mentally disturbed, he should not be given any such juvenile consideration. These petitions are filed by Delhi's writer, Shipa Arora Sharma & Chandigarh's lawyer, Salil Bali. The Bench had asked reply within a period of four weeks.

Whereas Salil Bali had debated on his/her own petition, other petition was debated by lawyer Vivek Sharma. Bali had challenged Juvenile Justice Act cl. (2) stating that the matter should not be based solely on his age but the seriousness of crime & his maturity. The lawyer, Sharma, told that a panel of doctors should conduct test to ascertain whether he is psychopath. He should not be left as per cl.(16) as it would be detrimental to the society. The petition also demands categorization of psychopaths citing Salim Qureshi, who found pleasure in killings. Also, Nithari case is cited & it is demanded to cancel cl.(16)

Vaccine: After Malaria, Scientist are claiming to be in the process of developing vaccine for Cholera. The Scientist at Telethon Inst. for Child health research stated that the patient's genom had been tested. On it's basis, the vaccine is being developed. It is a slowly spreading epidemic. The Sandfly mosquitos are the dreadly parasites, which are known as Genes Lismeniasis. The cholera affects multiple parts of body. It affects liver, spleen, & bone marrow. As per Nature genetics journal, many people from India, Bangladesh, Nepal, Sudan,South Sudan, Ethiopia & Brazil are affected by cholera. Every year 12 million people are seriously affected with 1.5 million new cases adding every year.
Chicago court: The Pak origin & Denmark newspaper blast mastermind & Lashkar aide, Tahavvur Rana, had been asked to be prosecuted for 30 years sentencing in prison. The US Attorney had stated in his letter before Chicago Court. On the other hand, Rana's counsel had told that due to his cardiac arrest in June 2012, he should be considered for lower sentence. His condition is deteriorating with kidney problems too. He also told that David Hadley is a fake person, who committed cheating with his school mate. They would not have any contact hereafter. Despite his friendship, he was not engaged in any sort of violence. He is charged with aiding terrorist organisation.
Pakistan is increasing it's nuclear arsenal but it is centred upon making smaller nuclear bombs, which can be used as missile warheads. "The Bulletin of the Atomic Scientist" had reported it. As per the journal, it would surpass Britain within a decade. It has started increasing it's plutonium reserves. Two reactors are being built whereas one additional chemical enrichment facility is being built. In nuclear notebook in 2011, it was stated that it would surpass Britain. Around 19,000 atomic weapons are present in the world. India, Pakistan & Israel has 100, 100 and 200 respectively. If the same trend continues, they would leave Britain behind. It has 225 nuke bombs. Between 1975 & 1980, Britain had 520 nuclear bombs.
Venezuela's President, Hugo Chavez, is struggling for life after undergoing surgery for cancer at Cuba. Chaotic situation prevails as he is not seen during past one month. The Deputy President told that his situation is serious. It was his fourth such operation. Due to his illness, his oath taking ceremony had to be postponed. But as per constitution, it can be taken within a month. He had been a Best Practices forerunner.

100Sc_Congress,SEBI&Rape_hearing&Acts

100th Indian Science Congress was started yesterday at Kolkata after being inaugrated by the President. He urged scientific community to help develop scientific tradition & seek for Nobel prize. He had also asked for dissemination of scientific information via latest modern equipments so that common man should be able to understand. It would help develop scientific community.
PM had appealed for resolving issues like Genetically modified food & Atomic Energy disputes. Such issues should be debated, analysed & understood for getting resolved. Therefore, scientific viewpoint is important like scientific capability. The changes in agricultural sector should be at top priority. Scientific apparatus should be used for reducing differences amidst rich & poor. They should be used to fulfill the needs of poor.

Insider Trading: SEBI is planning to change rules in regard to insider trading & front-running rules and would be made as per Company bill norms. Such rules would be in Company bill norms in addition to SEBI's own rules. The company rules have provisions wherein MD, CEO, CFO, Directors etc. would be restricted for share trading or forward dealing or prevent such trading based upon price sensitive news. It would be done after the Company bill is passed, which is pending before the Rajya Sabha.
SEBI would move ahead on its earlier decisions taken during 2012 i.e. Enforcement Action (consent order or talks), Transparency law(claim settlement after payment of fine), Pre-Market call auction (pressurising merchant bankers & issuers for price fixing of issue) & pricing discipline, eIPO start and Stock exchange regulation.
Offer for Sale (OFS) had brought some life in primary market. SEBI had also not increased the deadline for condition of completing 25% of public holding in listed cos.The last date is June 30, 2013.

Appeal & charges:The Delhi Police had file the chargesheet at the Delhi's Saket Court after consultation with the High Court lawyers. It had appealed before the metropolitan magistrate to conduct hearing in a closed room for keeping the victims identity as secret. The hearing is scheduled on Jan. 5. The Delhi Police appeal includes that neither the FIR nor the chargesheet should be disclosed. Besides, restricted entry should be made during the said hearing of the plea.
Delhi Legal Services Authority member stated that if the accused do not get lawyers, the authority would provide them. On the other hand, the relative of the victim's boyfriend told that if the case is not handled properly, they would appeal before the High Court.
Bone marrow test of one of the accused claiming to be not adult would be conducted to ascertain his exact age. The age mentioned in the HSC certificate is not considered to be the actual age. As per it, he is few months lesser than 18 years.
The charges are being framed under the following acts:
1.Act 302 for murder of the girl.
2.Act 307 for murder of the girl's boyfriend.
3.Act 365 for kidnapping
4.Act 396 for dacoitery & if murder, death penalty may happen.
5.Act 376(2G) for charges of gangrape resulting in lifetime imprisonment.
6.Act 384 for theft
7.Act 201 for destroying of evidence
8.Act 377 for unnatural sex

Internet30anniv,Indo-Pak,&Survey

Internet: The revolutionary networking had completed thirty years on Jan 1, 2013. As per a newspaper, the old networking system was removed and computer network started from Jan 1, 1983. The earlier network used was ARPA network by the US defence department. The Internet Protocol suite (IPS) was adopted later. It had paved the way for world wide web.
ARPA network was used during the decades of 1960s in military project. It was supported by California University & Stanford Research Institute. In 1973, IPS & transmission control protocol technique was started as the older network had some technical glitches.
Later, Tim Berners Lee had, in 1989, used Hyper Text Markup Language (HTML) with internet protocol, which is now known as www.

Indo-Pak relation: Yesterday continuously for the twenty secondth time, India exchanged it's list of Nuclear plants & other establishments along with those of the Pakistan. It had been done with the existing diplomatic relations amidst New Delhi & Islamabad for prevention of any nuclear attack. The said agreement was signed on Dec.31, 1988 and was effective from Jan 27, 1991. As per it, at the start of every calendar year, both countries would exchange the list of plants.

Spying: The Security forces have caught an eagle in the Kutch region used for spying purpose. It was caught at Indo-Pak border at Veeghakot outpost from pillar no. 1111 near the international border. The transmitter & antenna fixed on it would be sent for testing at the crime branch. An eagle was captured earlier, too, in 2008 from the Kutch region at Jhakau post.
Surveys: The Gujarat Assembly results had been declared along with HP State results, which had been delayed excessively. Although, Opinion/Exit poll surveys predicted Modi ahead of Congress but had GPP been able to divide the vote bank, it might had posed danger to Modi & his bigger image. During 2009 assembly elections, BJP got 35% votes whereas Congress got 32% votes, which is merely 3% difference. During this election, record polling had happened therein Gujarat.

A myth prevails that excessive polling goes against ruling party, but Bihar & Punjab elections had been able to break it. But thankfully, it had not happened so. It is to note that Since 1995, 42 States underwent polling, out of which 18 times it went in favour of ruling party whereas 26 times, it went against ruling parties.

An important factor is that youths involvement had made elections reach 70% polling. Around 40% of voters were of the age group 18-40 years, which indicate one sided results either in favour or in opposition. The analyst state that on development issue, inclination for Modi is far obvious as he had conducted a youth rally too. It could have been the turning point for Modi?
